
NOTICE OF FINDING OF NO SIGNIFICANT IMPACT AND NOTICE OF INTENT TO REQUEST RELEASE OF FUNDS DATE OF NOTICE: October 7, 2021 RESPONSIBLE ENTITY: Allegheny County ADDRESS: Chatham One, Suite 900 112 Washington Place Pittsburgh, PA 15219 TELEPHONE: 412-350-1000 These notices shall satisfy two separate but related procedural requirements for activities to be undertaken by Allegheny County Housing Authority (ACHA). REQUEST FOR RELEASE OF FUNDS On or about October 23, 2021, Allegheny County will authorize ACHA to submit a request to the U.S. Department of Housing and Urban Development (HUD) for the release of federal Capital Fund grant funds, authorized under Section 9 (d) and Section 30 of the U.S. Housing Act of 1937 (42 U.S.C. 1437g(d) and 1437z-2). Funding will be used for the construction of 51-affordable housing units which will include 7 public housing units and 9 project-based voucher units in this total of 51 units. The location of the development is 2904 Castlegate Avenue, Pittsburgh, PA 15226. Estimated funding: FY 2020-2021-2022 Capital Fund Grant of $ 1,850,000. FINDING OF NO SIGNIFICANT IMPACT (FONSI) Allegheny County has determined that the project will have no significant impact on the human environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act (NEPA) of 1969 is not required. PUBLIC COMMENTS Any individual, group or agency may submit written comments on the ERR to Allegheny County Economic Development, Chatham One, Suite 900, 112 Washington Place, Pittsburgh, PA 15219, Attention: Lance Chimka, Director. Comments may also be submitted via email at lance.chimka@alleghenycounty.us. The ERR can be accessed online at the following website:https://www.hudexchange.info/programs/environmental-review/environmental-review-records/. All comments received by October 22nd, 2021 will be considered by the County prior to authorizing submission of a request for release of funds. Comments should specify which Notice they are addressing. ENVIRONMENTAL CERTIFICATION Allegheny County certifies to HUD that Rich Fitzgerald in his capacity as County Executive, consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. HUD's approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows ACHA to use Program funds. OBJECTIONS TO RELEASE OF FUNDS HUD will accept objections to its release of funds and the County's certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on the following bases: (a) the certification was not executed by the Certifying Officer of the County; (b) the County has omitted a step or failed to make a determination or finding required by HUD regulations at 24 CFR part 58; (c) the grant recipient or other participants in the development process have committed funds, incurred costs or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by HUD; or (d) another federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58, Sec. 58.76) and shall be addressed to the Director of the Pittsburgh Field Office of Public and Indian Housing, at michael.a.horvath@hud.gov. and (412) 644-5945.
